  • Schedule V. Drugs with low abuse potential and accepted medical use, primarily consisting of over-the-counter cough suppressants and antidiarrheal medications.

Texas Drug Penalty Groups

These groups determine the severity of criminal charges and potential punishments associated with drug possession, manufacture, or delivery.

The penalty groups are as follows:

  • Penalty Groups 1, 1-A, 1-B. These groups contain drugs with the highest potential for abuse and limited or no accepted medical use, such as heroin, cocaine, methamphetamine, and fentanyl. Penalties for offenses involving these substances are typically the most severe.
  • Penalty Groups 2, 2-A. These groups include hallucinogens, some synthetic drugs, and certain central nervous system depressants. The potential for abuse and associated penalties are less than Penalty Group 1, but still significant.
  • Penalty Groups 3 & 4. These groups encompass prescription stimulants, depressants, and some narcotics with recognized medical uses. Generally, penalties for offenses involving these substances are less severe than the previous groups.
  • Dangerous Drugs & marijuana. These classifications include specific substances with unique penalty structures, often separated due to ongoing legislative debates or specific concerns.
